Is At-Home Cultivation Allowed in West Virginia?

What the Law Says Today

Under the current medical marijuana program, only licensed growers approved by the state are allowed to cultivate marijuana plants. Proposed Change: Home Cultivation Could Be Allowed

There is a bill moving through the West Virginia legislature, House Bill 5259, that could change this. If passed and signed into law, the bill would allow qualified medical marijuana patients and caregivers to grow a limited number of marijuana plants at home for personal medical use.


Here is what the proposal includes:

  • Registered patients and caregivers could grow up to 10 marijuana plants at home.

  • No more than five plants could be mature and flowering at any given time.

  • The marijuana grown would only be for personal medical use, not for sale or sharing.

Allowing patients to grow marijuana at home could provide several benefits:

House Bill 5259 is still pending in the legislature. If it passes both chambers and is signed by the governor, home cultivation would become legal under the rules described above. Until then, growing marijuana at home remains illegal, and patients can continue to purchase their medicine through licensed dispensaries.
