Will Medical Marijuana Revenue Finally Be Distributed in West Virginia?

West Virginia’s medical marijuana program has brought in millions of dollars, but most of that revenue hasn’t been spent. Now, lawmakers are pushing to finally put that money to work for the state.


What Has Happened With the Money?

Since the state’s first medical marijuana dispensary opened in 2021, West Virginia has collected millions of dollars from product sales, taxes, and business licensing fees. A report from late 2025 found that the program had brought in around $34 million to date, but not a single dollar was used for the programs it was meant to fund.


According to West Virginia’s marijuana laws, this money is supposed to go toward things like funding medical marijuana research programs, helping people with substance use disorders, and providing training for law enforcement. The main reason the funds are sitting unused is federal law. Marijuana remains illegal at the federal level, classified as a Schedule I drug. This creates a legal gray area, and the state Treasurer’s Office has been hesitant to release the money for fear of federal repercussions.


Meanwhile, other states with medical marijuana programs have spent similar funds on research, treatment programs, and community support, showing it’s possible to use the money effectively without breaking federal rules.


Lawmakers’ Efforts to Fix It

On February 3rd, lawmakers introduced House Bill 5074, a bill that aims to release the unused medical marijuana revenue so it can finally benefit the state. The proposal would direct all revenue from medical marijuana sales into the state’s general fund first and then distribute it for specific purposes, including:


Some lawmakers have raised concerns that certain allocations, like funding law enforcement, may not directly support the medical marijuana program. Still, supporters see this as a real opportunity to finally use the millions of dollars already collected.


What Comes Next?

The bill must go through committee hearings, debates, and votes in both the House and Senate. There is some resistance because of ongoing concerns about federal law, but if the bill passes, West Virginia could begin distributing the medical marijuana revenue that has been sitting unused for years.
