  • An individual designated by a patient or legal guardian

  • An appropriate individual approved by the Bureau upon sufficient showing that no parent or legal guardian is appropriate or available

In order to become a caregiver in West Virginia, eligible prospects must submit an application online and undergo a criminal history background check.


Who Would Make a Good Caregiver?

If you are going to choose someone to be your caregiver, you should ask someone who is very reliable and a person you can count on. The person should be willing to learn about marijuana laws in your state, as well as the benefits of marijuana.


Your caregiver must familiarize themselves with applicable laws and regulations regarding purchasing and transporting cannabis. It is also helpful if they know about the effects and strains of cannabis, so they can help the dispensary employees pick out the best type of medicine for your personal needs.


Ideally, your caregiver should have their own mode of transportation, so they can bring you your medication. Your caregiver should feel comfortable with the effects cannabis can have on a person.


A caregiver can have more than one patient, but a patient cannot have more than one caregiver. Some caregivers also provide patient transportation to and from dispensaries or doctor’s appointments.


Caregiver Responsibilities

  • Make sure patient has an active West Virginia marijuana card

  • Legally access and purchase cannabis for patient

  • Safely transport patient medication

  • Caregivers can grow their own marijuana in West Virginia for their patients

  • Comply with cultivation laws and regulations

  • Administer medicine for patients if needed


Caregiver Rules

  • Cannot consume any of their patient’s cannabis supply

  • Cannot cultivate cannabis for anyone other than their designated patients

  • Cannot give away or sell their patient’s cannabis
